Terms & Conditions

1. Reservation and Booking:

• All reservations and bookings are subject to availability and confirmation. A valid credit card will be required when booking.

2. Payment:

• Unless otherwise noted, full payment is due at the time of booking. We accept all major credit cards and digital wallets. Prices are as listed and are subject to change without notice.

3. Cancellation and Refund:

• We realize that unexpected situations may arise, leading to the need for a cancellation. We require 48 hours notice of cancellation, unless cancellation protection is purchased. We offer the option to reschedule within the current season, or in the event of inclement weather. Rescheduling is not always possible. Less than 48 hours notice of cancellation are non refundable.

4. Changes and Modifications:

• Changes to the reservation date, time, or participants may be accommodated based on availability and approval. Modifications may be subject to additional charges.

5. Equipment Rental:

• Customers renting equipment are responsible for its proper use, care, and return in the condition received. Any damages or loss may result in additional charges.

6. Assumption of Risk:

• Participation in outdoor activities involves inherent risks. Participants acknowledge and accept these risks and release On The Water LLC from liability for injuries or damages.

7. Weather and Safety:

• Weather conditions may affect activities. On The Water LLC reserves the right to modify or cancel activities based on safety considerations. In such cases, alternative arrangements or refunds may be warranted.

8. Liability Waiver:

• All participants 18 years and older must sign a liability waiver. Parents or legal guardians must sign on behalf of minor participants.

9. Termination of Services:

• On The Water LLC reserves the right to terminate services for any participant who poses a safety risk or fails to comply with instructions without issuing a refund.

10. Governing Law:

• These terms are governed by and construed following the laws of the state of South Dakota. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the South Dakota courts.

11. Changes to Terms:

• On The Water LLC reserves the right to update or modify these terms without prior notice. Changes will be effective upon posting on our website.
